San Angelo man receives two years for sexual assault of a child

Joshua Gene Fulton pleaded guilty to a charge of sexual assault of a child as part of a plea agreement Tuesday. He received a two-year jail term for the offense.

According to court documents, the incident involved a child under the age of 17 on Oct. 17, 2014. Leading up to the plea agreement, a psychological examination and evaluation was preformed to determine if Fulton was competent to stand trial in December 2015.

Fulton was in a relationship with the 14 year-old female and was living at the home of the girl, with her parents’ permission. By law, if Fulton was within in three years of age of the victim, he would have had an affirmative defense to the assault.

According to District Attorney Allison Palmer, this boyfriend and girlfriend were too far apart in age for Fulton to have a legal defense to the sexual component of their relationship.

Fulton was booked into the Tom Green County Jail Feb. 11, 2015. He was led out of the Tom Green County Courthouse in an orange jumpsuit after the hearing Tuesday.
