A man is to stand trial for sexual assault of a child that resulted in a pregnancy

Jacob Lee Mediano appeared before potential jurors in the Tom Green County Courthouse Monday morning. Mediano is facing a first degree felony charge of aggravated sexual assault of a child younger than 14 years of age. 

According to court documents, Mediano knowingly had sexual contact with a child younger than 14 years of age around July 15, 2013.

In February 2014, a caseworker with Child Protective Services was contacted and was advised of a child who is 13 years of age and possibly pregnant. After a forensic interview with the victim, CPS obtained a judge’s order to take the victim to a physician for a pregnancy test. The test confirmed the victim was 30 weeks pregnant. It was determined the due date for the victim was April 15, 2014. That would make her 12 years old at the time of conception. The child was then taken into CPS custody.

While in custody a CPS worker located text messages on the victim’s phone that indicated the victim and defendant, Jacob “Jake” Mediano, had been sleeping in the same bed at the victim’s residence on Abilene Street. It was also discovered at that time that Mediano is the paternal uncle of the victim.

The victim gave birth to a baby girl on April 16, 2014, making the conception date to be sometime in July 2013. While in the hospital, a Court Appointed Special Adovocate (CASA) worker saw a letter from the victim addressed to Mediano that claimed he was the father of the newborn baby. The victim also told her attorney at the time that she was not forced into a sexual relationship.

The trial begins Tuesday morning.
